Welcome to dontusemyface.com ("Service", "we", "our", or "us"), operated by Face Protection Registry. These Terms of Service ("Terms") govern your access to and use of our website and services.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Service Description

dontusemyface.com is a face protection registry service designed to help individuals protect their likeness from unauthorized use in AI-generated content. Our service:

  • Allows users to register their facial likeness for protection
  • Provides a verification API for AI companies to check consent status
  • Maintains audit trails of verification requests
  • Offers a dashboard for users to monitor activity

Current status: We are currently in Phase 0 (waitlist phase). Full service features will be available upon launch.

3. Eligibility

To use our Service, you must:

  • Be at least 18 years old — Due to the nature of biometric data processing, our Service is restricted to adults only.
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws

By using our Service, you represent and warrant that you meet all eligibility requirements.

4. Account and Registration

Waitlist phase: Currently, you may provide your email address to join our waitlist. By doing so, you agree to receive communications from us regarding the Service launch and updates.

Upon launch: You will be required to create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities under your account

5. Acceptable Use

You agree not to:

  • Register anyone's face other than your own without their explicit consent
  • Use the Service for any illegal or unauthorized purpose
  • Attempt to circumvent any security measures of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Impersonate another person or entity
  • Upload malicious code or content
  • Violate any applicable laws or regulations

6. Biometric Data Processing

Upon service launch, we will process biometric data (facial embeddings) to provide our protection service. By using our Service, you acknowledge and consent to the following:

  • Photo processing: Your uploaded photo will be converted into a mathematical embedding (numerical representation) and immediately deleted.
  • Embedding storage: Only the embedding is stored, not your original photo.
  • Non-reversible: The embedding cannot be used to reconstruct your face.
  • Verification use: Your embedding will be used to verify consent status when AI companies query our registry.

7. Service Limitations

You understand and acknowledge that:

  • Voluntary adoption: Our protection depends on AI companies voluntarily integrating with our verification API.
  • No guarantee: We cannot guarantee that all AI systems will check our registry before generating faces.
  • Best effort: We work continuously to expand our network of participating AI companies.
  • Audit trail: We provide audit trails that may serve as evidence, but we do not provide legal services.

8. Intellectual Property

Our IP: The Service, including its design, features, and content (excluding user content), is owned by Face Protection Registry and protected by intellectual property laws.

Your IP: You retain all rights to your personal data and biometric information. By using our Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

9. Fees and Payment

Basic protection: Our basic face protection service is free for individual users and will remain free.

Premium features: We may offer premium features in the future. Any paid features will be clearly communicated with pricing before you are charged.

Revenue model: We generate revenue from AI companies that pay for access to our verification API, not from individual users.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of content

We do not warrant that the Service will be uninterrupted, secure, or error-free.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACE PROTECTION REGISTRY SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to your data
  • Damages resulting from AI companies that do not use our verification service

Our total liability shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Face Protection Registry and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

By you: You may terminate your use of the Service at any time by deleting your account or requesting removal from our waitlist.

By us: We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.

Effect of termination: Upon termination, your right to use the Service will cease. We will delete your data in accordance with our Privacy Policy.

14. Governing Law and Disputes

These Terms are governed by the laws of the European Union and the member state where Face Protection Registry is established.

Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the competent courts of the jurisdiction where Face Protection Registry is established.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Face Protection Registry regarding your use of the Service.
